Terms of Service

These Terms explain how Huckleberry dumpster rentals work, what you can expect from us, and what we ask from you in return. We have written them to be clear, practical, and easy to understand.

Quick summary

1. Agreement and definitions

These Terms of Service are an agreement between Huckleberry Dumpsters LLC, referred to as “Huckleberry Dumpsters,” “we,” “us,” or “our,” and the person or organization ordering, receiving, paying for, or using our services, referred to as the “Customer,” “you,” or “your.”

By placing an order, approving a quote, providing payment information, accepting delivery, signing or electronically accepting a rental agreement, or using our equipment, you confirm that you have read, understood, and agreed to these Terms.

You must be at least 18 years old and legally authorized to accept these Terms. If you order for a company, contractor, property owner, tenant, property manager, HOA, or other organization, you confirm that you have authority to act for that party.

Definitions used throughout these Terms

  • Customer: The person or organization responsible for the order, payment, placement instructions, dumpster contents, and compliance with these Terms.
  • Dumpster: Each individual roll-off container and any related equipment supplied by Huckleberry Dumpsters.
  • Order: The confirmed booking, invoice, quote, package, addendum, or written service agreement for a particular rental.
  • Rental Period: The period beginning when a dumpster is delivered and ending when it is retrieved by Huckleberry Dumpsters.
  • Package Rental: Two dumpsters rented together and sold as a combined 30-yard or 40-yard package.
  • Commercial Project: A rental connected to a business, contractor, construction project, property management operation, or other non-household use.
  • Active Jobsite: A project where one or more Huckleberry dumpsters remain in recurring or ongoing service through deliveries, pickups, returns, or exchanges.
  • Written Approval: Approval shown in an order, invoice, email, text message, or other electronic record from Huckleberry Dumpsters.

You are responsible for obtaining permission from the property owner and any permit, HOA approval, right-of-way authorization, or other approval required for the placement location.

2. Booking, quotes, and payment

Your Order and these Terms together form the rental agreement. If a written quote, invoice, package, or signed addendum contains a service-specific term that differs from these general Terms, the service-specific term controls for that Order.

Quotes are based on the information available when they are prepared, including the project description, delivery location, requested service, anticipated materials, access conditions, disposal rules, and expected scope. A quote may be revised if the project, materials, delivery conditions, services, disposal costs, government charges, or other material facts change.

Prices and included services are those shown in the Order. Unless a written quote specifically states otherwise, a quote is not a guarantee of final load weight, disposal cost, special handling cost, trip count, rental duration, or charges caused by conditions that were not reasonably known when the quote was prepared.

By providing a payment method, you authorize Huckleberry Dumpsters and its payment processor to charge that method for the original Order and for any additional amount properly owed under the Order or these Terms. This may include excess weight, extra days, unsuccessful trips, prohibited materials, special disposal, damage, permits, taxes, and documented costs caused by the rental.

When an owner, contractor, subcontractor, tenant, property manager, employee, customer, or other person participates in a project, the Customer who places the Order remains responsible for payment and compliance unless Huckleberry Dumpsters agrees otherwise in writing.

A declined card, returned check, rejected ACH payment, or chargeback does not cancel your obligation to pay. To the extent permitted by law, you are responsible for applicable processor or bank charges, reasonable collection costs, court costs, attorneys’ fees, and lawful interest on unpaid balances.

Our booking records, invoices, payment records, disposal-facility scale tickets, photographs, video, text messages, emails, GPS or map information, driver notes, and service records may be used to document the rental and calculate amounts properly due.

3. Delivery and placement

You must provide an accurate delivery address, clear placement instructions, and a safe location with enough room for our truck to enter, place the dumpster, and leave safely. Pets must be secured, and people must remain clear of the truck and equipment during delivery, exchange, relocation, and pickup.

The travel route and placement area must be reasonably level, stable, and clear of vehicles, buildings, rooflines, fences, gates, low branches, wires, utility lines, septic systems, irrigation components, soft ground, and other hazards.

You are responsible for identifying overhead restrictions and known or hidden underground conditions, including sprinklers, irrigation lines, water or gas lines, electrical or communication lines, septic tanks, drain fields, dry wells, French drains, culverts, utilities, and other improvements.

By directing or approving placement through a map pin, booking tool, photograph, text, email, phone instruction, or on-site direction, you confirm that the location is authorized and reasonably suitable for heavy commercial equipment. We may reasonably rely on the instructions and information you provide.

Our driver has final authority over placement and may select a safer nearby location, require different instructions, delay service, or refuse a placement that appears unsafe or could endanger people, property, our truck, or the dumpster.

If you authorize unattended delivery, you accept a placement made in reasonable reliance on your instructions, subject to the driver’s safety judgment. A dumpster may not be placed on a street, sidewalk, alley, easement, or other public area without all required approvals.

Driveway protection

When available and appropriate for the site, driveway protection may be included or provided as shown in your Order. Driveway protection is designed to reduce direct contact between the dumpster and the placement surface, but it cannot eliminate every risk associated with heavy equipment.

Driveway protection does not guarantee that asphalt, concrete, pavers, gravel, or other surfaces will remain free from cracks, marks, impressions, settling, stains, or other damage. Our driver may decide that protection equipment cannot be used safely or effectively at a particular location.

4. During your rental

Responsibility for the dumpster and its contents transfers to you when delivery is completed and remains with you until Huckleberry Dumpsters retrieves it.

You are responsible for every item placed in the dumpster during that time, including items placed by family members, guests, employees, tenants, contractors, subcontractors, neighbors, passersby, or unknown third parties.

You are responsible for:

  • Everything placed in the dumpster, regardless of who placed it there
  • Keeping the dumpster and the complete pickup route accessible
  • Taking reasonable steps to prevent unauthorized dumping
  • Keeping children and pets away from the dumpster
  • Keeping all debris below the top rail
  • Loading material evenly and safely
  • Protecting the dumpster from fire, impact, misuse, theft, and vandalism
  • Contacting us promptly if your plans, materials, access, or pickup needs change

You may not tow, drag, push, winch, lift, relocate, transport, modify, paint, mark, climb on, burn in, attach items to, sublease, conceal, sell, or allow another hauler to handle the dumpster without our written approval. This includes movement with a forklift, skid steer, tractor, loader, excavator, truck, trailer, chain, cable, or other equipment.

If a dumpster is moved without approval, you are responsible for resulting damage, recovery, inspection, relocation, delay, and other reasonable costs.

5. Weight, loading, and materials

Disposal weight is determined by the certified scale used by the receiving disposal facility unless your written agreement states otherwise. The facility’s recorded weight controls the calculation of included weight and overage charges, subject to correction of an obvious clerical or scale error.

You are responsible for the entire weight of the load, including dense or heavy materials hidden beneath, mixed with, or covered by lighter debris. Weight allowances may not be transferred from one dumpster to another unless we specifically agree in writing.

Nothing may extend above the top rail or beyond the sides, front, or rear of the dumpster. You may not compact material with heavy machinery or create an unstable, unbalanced, leaking, or unsafe load.

We will not transport a dumpster that we reasonably believe is overloaded, unsafe, leaking, unlawful, or likely to damage equipment. You must remove or rearrange material at your expense before pickup. Additional rental, labor, trip, or disposal charges may apply.

Heavy materials

Concrete, dirt, brick, block, rock, asphalt, roofing, plaster, sod, large stumps, and other dense materials require approval before loading. Approval may require a reduced fill level, specific dumpster size, separate load, restricted material type, or additional charge. Mixing heavy material with household or construction debris does not remove the weight or handling risk.

Prohibited materials

The following may not be placed in a dumpster unless we give specific written approval:

  • Hazardous, toxic, corrosive, reactive, flammable, or infectious waste
  • Wet paint, solvents, fuel, oil, chemicals, pesticides, and liquid waste
  • Batteries, lithium batteries, propane tanks, pressurized cylinders, fireworks, ammunition, explosives, hot ashes, hot charcoal, burning material, and items capable of starting a fire
  • Medical waste, needles, biological waste, and bodily fluids
  • Asbestos, radioactive material, and contaminated soil
  • Refrigerant-containing appliances that have not been properly prepared
  • Weapons or other items prohibited by law or rejected by the receiving facility

Items requiring advance approval or special disposal

Tires, mattresses, televisions, large appliances, refrigerant appliances, large stumps, and similar items may require advance approval and additional disposal charges. Current disposal-facility rules determine whether an item can be accepted and what handling charge applies.

Huckleberry Tip: If you are unsure whether an item is allowed, call or text before loading it. A quick question can prevent a much larger disposal charge.

6. Package rentals

Package Rentals provide two separate dumpsters under one package price. Each dumpster remains a separate container with its own rental period, included weight, loading requirements, scale ticket, and possible overage charges.

Package pricing and scheduling are shown in your Order. Unless the Order says otherwise, a package does not combine or pool the included weight between the two dumpsters. For example, unused weight in one dumpster does not offset excess weight in the other.

The Order will identify whether the dumpsters are delivered together, delivered separately, or exchanged during the project. Additional deliveries, exchanges, relocations, wait time, rental days, or trips outside the included package may be charged at current rates.

Package pricing applies only to the dumpsters and services identified in the Order. Substitutions, changes in dumpster size, extended rental periods, or materially different project conditions may require a revised quote.

7. Commercial projects and active jobsites

Commercial Projects and Active Jobsites may use custom pricing, recurring service, separate billing terms, purchase orders, multiple dumpsters, exchanges, scheduled pickups, or other project-specific arrangements. Those details must be stated in the Order, quote, account agreement, or written addendum.

Unless we agree otherwise in writing, the Customer remains responsible for all dumpsters, loads, access conditions, instructions, and charges at the project, including actions by employees, subcontractors, suppliers, tenants, property owners, and other people using the site.

The Customer must provide a safe staging and service area, coordinate access, keep the route clear, communicate site rules, and ensure that everyone loading a dumpster follows these Terms. Huckleberry Dumpsters is not responsible for supervising the Customer’s workers or controlling materials placed in a dumpster between service visits.

A requested exchange, pickup, relocation, or return is subject to route and equipment availability. A request is not confirmed until accepted by Huckleberry Dumpsters. Site schedules, inspections, subcontractor timelines, and project deadlines do not create a guaranteed service time unless we specifically agree in writing.

Discounted, recurring, or Active Jobsite pricing may be changed or withdrawn for future service if the project scope, disposal stream, access, fuel or disposal cost, service frequency, payment history, or other material condition changes. Any change applies prospectively unless otherwise agreed.

A purchase order or internal customer document does not modify these Terms or add obligations for Huckleberry Dumpsters unless we expressly accept the change in writing.

8. Additional charges

Other charges may apply for prohibited materials, special disposal, equipment damage, unusual labor, hand loading or unloading, sorting, emergency response, permits, taxes, return trips, recovery, relocation, or actual documented costs caused by the rental.

Government charges, disposal-facility fees, environmental fees, or unusual surcharges imposed after booking may be passed through when permitted by law and reasonably documented.

We base additional charges on the Order, these Terms, scale tickets, photographs, video, messages, GPS records, service notes, actual costs, and documented conditions at the property or disposal facility.

9. Pickup, extensions, and cancellations

Unless your Order says otherwise, a standard rental includes up to two rental days. The Rental Period begins when the dumpster is delivered and ends when it is retrieved. The scheduled pickup date does not end your responsibility if the dumpster cannot be safely retrieved because of Customer-caused access, loading, or site conditions.

Additional days are subject to availability and charged at $20 per dumpster, per day unless another written rate applies. Please request an extension before the scheduled pickup whenever possible. An extension is not confirmed until accepted by Huckleberry Dumpsters.

Pickup windows and route times are estimates, not guaranteed appointments. Routing, weather, traffic, disposal-facility hours, jobsite conditions, and equipment availability may affect timing.

The dumpster and full approach route must be safely accessible. Parked vehicles, locked gates, snow, ice, mud, construction activity, low branches, loose animals, blocked access, overloaded material, or other unsafe conditions may result in a $75 trip fee and continued rental charges until service can be completed.

A delay caused solely by Huckleberry Dumpsters will not be treated as an additional rental day.

Orders cancelled more than 24 hours before scheduled delivery are not subject to a cancellation fee unless we have already incurred a clearly disclosed, nonrefundable project cost. Cancellations within 24 hours may be charged $50. If our truck has been dispatched, a $75 trip fee may apply.

10. Equipment damage, property risk, and liability

All dumpsters, protective equipment, and related property remain owned by Huckleberry Dumpsters.

You are responsible for damage beyond ordinary wear and tear caused by misuse, prohibited materials, fire, impact, machinery, unauthorized movement, vandalism, theft, overloading, or another event while the dumpster is in your possession or control, except to the extent caused by Huckleberry Dumpsters.

Dumpster delivery and pickup involve heavy commercial equipment. Even when reasonable care is used, the truck, dumpster, or protective equipment may leave marks, impressions, cracks, ruts, stains, settling, or other damage on asphalt, concrete, pavers, gravel, lawns, landscaping, curbs, or underground improvements.

You accept the ordinary and foreseeable risks of placing heavy equipment at the selected location, including risks created by weak, aged, hidden, improperly constructed, saturated, frozen, thawing, or weather-affected surfaces. This includes risks involving sprinklers, irrigation systems, utilities, septic systems, drain fields, dry wells, French drains, culverts, and other conditions that are not visible to our driver.

You must promptly report property damage, equipment damage, safety concerns, billing questions, or service concerns. Preserve relevant photographs, video, messages, and other evidence, and allow us a reasonable opportunity to inspect before repairs are made, except when immediate action is reasonably necessary to prevent injury or additional damage.

Huckleberry Dumpsters remains responsible for damage to the extent directly caused by our negligence or willful misconduct, subject to applicable law.

To the fullest extent allowed by law, Huckleberry Dumpsters is not liable for lost profit, lost business, loss of use, project delay, missed deadlines, loss of data, or other indirect, incidental, special, exemplary, or consequential damages.

You agree to defend, indemnify, and hold harmless Huckleberry Dumpsters LLC and its owners, employees, agents, and service providers from third-party claims, fines, losses, damages, and reasonable costs arising from prohibited materials, unauthorized placement or movement, unlawful use, negligence, misrepresentation, violation of law, or breach of these Terms, except to the extent caused by Huckleberry Dumpsters’ negligence or willful misconduct.

11. Delays and refusal of service

Unless we specifically agree otherwise in writing, delivery, exchange, and pickup times are estimates rather than guaranteed appointment times.

We may delay, reroute, reschedule, suspend, or cancel service because of severe weather, wildfire, smoke, excessive heat, snow, ice, flooding, high winds, road restrictions, traffic incidents, disposal-facility closures or delays, mechanical problems, labor or material shortages, emergencies, governmental action, or another condition outside our reasonable control.

We may refuse, stop, or terminate service when our driver or another representative reasonably believes the service would be unsafe, unlawful, abusive, fraudulent, materially different from what was ordered, harmful to equipment or property, or inconsistent with disposal-facility requirements.

If fire, smoke, heat, leaking material, a chemical reaction, or another hazardous condition is found, we may contact emergency services, isolate or unload the dumpster, and take other reasonable protective action. You are responsible for resulting costs to the extent the condition was caused by prohibited material, misuse, negligence, or a breach of these Terms.

We may refuse future service for nonpayment, chargebacks, threats, harassment, repeated access problems, intentional misuse, prohibited materials, unsafe conditions, or serious or repeated violations of these Terms.
