Huckleberry Standard
Terms of Service
These Terms explain how our dumpster rentals work, what you can expect from us, and what we ask from you in return. We have kept them as clear and straightforward as possible.
Quick summary
1. Before you rent
These Terms are an agreement between Huckleberry Dumpsters LLC, referred to as “Huckleberry Dumpsters,” “we,” “us,” or “our,” and the person or organization ordering or using our services, referred to as the “Customer,” “you,” or “your.”
By placing an order, accepting delivery, signing or electronically accepting a rental agreement, or using our equipment, you confirm that you have read, understood, and agreed to these Terms.
You must be at least 18 years old and legally authorized to accept these Terms. If you rent on behalf of a company, contractor, property owner, or other organization, you confirm that you have authority to do so.
You are responsible for obtaining permission from the property owner and any permit, HOA approval, right-of-way authorization, or other approval required for the placement location.
2. Booking and payment
Your order confirmation, invoice, written quote, selected rental package, and these Terms together form the rental agreement. If a written quote or order contains a service-specific term that differs from these general Terms, the service-specific term controls for that order.
Prices and included services are those shown or quoted when the order is placed. By providing a payment method, you authorize Huckleberry Dumpsters and its payment processor to charge that method for the rental and any additional amount properly owed under these Terms.
Additional charges may include excess weight, extra rental days, blocked access, unsuccessful trips, prohibited materials, special disposal costs, damage, permits, taxes, and other charges described in these Terms or disclosed before they are incurred.
When an owner, contractor, subcontractor, tenant, property manager, employee, or other person is involved in a project, the Customer who places the order remains responsible for payment and compliance with these Terms unless Huckleberry Dumpsters agrees otherwise in writing.
A declined payment, returned check, rejected ACH payment, or chargeback does not cancel your obligation to pay. To the extent permitted by law, you are responsible for applicable bank or processor charges, reasonable collection costs, court costs, attorneys’ fees, and lawful interest on unpaid balances.
Our order records, invoices, disposal-facility scale tickets, photographs, messages, GPS or map records, and service notes may be used to document the rental and calculate amounts properly due.
3. Delivery and placement
You must provide an accurate delivery address and a safe placement location with enough room for the truck to enter, place the dumpster, and leave safely. Pets must be secured and people must remain clear of the truck and equipment during delivery and pickup.
The route and placement area must be reasonably level, stable, and clear of vehicles, buildings, rooflines, fences, gates, low branches, wires, utility lines, septic systems, irrigation components, soft ground, and other hazards.
You are responsible for identifying overhead restrictions and any known underground conditions, including sprinklers, irrigation lines, water or gas lines, electrical or communications lines, septic tanks, drain fields, dry wells, French drains, culverts, and other hidden improvements.
By directing or approving the placement location, including through a map pin, photograph, text message, email, phone instruction, or on-site direction, you confirm that the location is authorized and reasonably suitable for heavy equipment. We may rely on the placement information you provide.
Our driver has final authority over placement and may refuse the requested location, require another location, or stop service whenever conditions appear unsafe or could endanger people, property, the truck, or the dumpster.
If you authorize unattended delivery, you accept the placement made in reasonable reliance on the instructions and information you provided, subject to the driver’s safety judgment.
A dumpster may not be placed on a public street, sidewalk, alley, easement, or other public area without all required approvals.
Optional driveway protection
Driveway protection is available for $20 per delivery when selected before delivery. It is designed to reduce direct contact between the dumpster and the placement surface.
Driveway protection reduces risk but does not guarantee that asphalt, concrete, pavers, gravel, or other surfaces will remain free from cracks, marks, impressions, settling, stains, or other damage. If you decline driveway protection, you accept the increased risk of placing the dumpster directly on the selected surface.
4. During your rental
Responsibility for the dumpster and its contents transfers to you when delivery is completed and remains with you until Huckleberry Dumpsters retrieves it.
You are responsible for every item placed in the dumpster during that period, including items placed by family members, guests, employees, tenants, contractors, subcontractors, neighbors, passersby, or unknown third parties.
You are also responsible for:
- Everything placed in the dumpster, regardless of who placed it there
- Keeping the dumpster and pickup route accessible
- Preventing unauthorized dumping when reasonably possible
- Keeping children and pets away from the dumpster
- Keeping debris below the top rail
- Loading material evenly and safely
- Contacting us if your plans, access, or pickup needs change
You may not move, modify, paint, mark, climb on, burn in, attach items to, sublease, hide, sell, or allow another hauler to transport the dumpster without our written approval.
5. Weight, loading, and materials
| Dumpster | Included weight | Overage rate |
|---|---|---|
| 15-yard dumpster | 3,000 lbs. / 1.5 tons | $0.04 per lb. over |
| 20-yard dumpster | 4,000 lbs. / 2 tons | $0.04 per lb. over |
| Huck & Go | As shown in your order | $0.06 per lb. over |
Disposal weight is determined by the certified scale used by the receiving disposal facility unless your written agreement states otherwise. The facility’s recorded weight will control the calculation of included weight and overage charges, subject to correction of an obvious clerical or scale error.
Nothing may extend above the top rail or from the sides, front, or rear of the dumpster. You may not compact material with heavy machinery or create an unstable, unbalanced, leaking, or unsafe load.
We will not transport a dumpster that we reasonably believe is overloaded, unsafe, leaking, or unlawful to haul. You must remove or rearrange material at your expense before pickup. Additional rental, labor, trip, or disposal charges may apply.
Heavy materials
Concrete, dirt, brick, block, rock, asphalt, roofing, plaster, sod, large stumps, and other dense materials require approval before loading. Approval may include a reduced fill level, a specific dumpster size, a separate load, or additional charges.
Prohibited materials
The following may not be placed in the dumpster unless we give specific written approval:
- Hazardous, toxic, corrosive, reactive, flammable, or infectious waste
- Wet paint, solvents, fuel, oil, chemicals, pesticides, and liquid waste
- Batteries, lithium batteries, propane tanks, pressurized cylinders, fireworks, ammunition, explosives, hot ashes, hot charcoal, burning material, and any item capable of starting a fire
- Medical waste, needles, biological waste, and bodily fluids
- Asbestos, radioactive material, and contaminated soil
- Refrigerant-containing appliances that have not been properly prepared
- Any material prohibited by law or rejected by the receiving facility
Items requiring advance approval or special disposal
Tires, mattresses, televisions, large appliances, refrigerant appliances, large stumps, and similar items may require advance approval and additional disposal charges. Current disposal-facility rules control whether an item can be accepted.
6. Additional charges
| Item | Charge |
|---|---|
| Additional rental day | $20 per dumpster, per day |
| Optional driveway protection | $20 per delivery |
| Standard weight overage | $0.04 per pound |
| Huck & Go weight overage | $0.06 per pound |
| Blocked, inaccessible, or unsuccessful trip | $75 |
| Cancellation within 24 hours | $50 |
| Cancellation after dispatch | $75 trip fee |
Other charges may apply for prohibited materials, special disposal, equipment damage, unusual labor, permits, taxes, return trips, or actual costs caused by the rental. Government charges, disposal-facility fees, or extraordinary surcharges imposed after booking may be passed through only when permitted by law and reasonably documented.
We base additional charges on your order, these Terms, disposal tickets, photographs, service records, actual costs, or documented conditions at the property.
7. Pickup, extensions, and cancellations
Unless your order says otherwise, standard rentals include up to two rental days. The rental begins when the dumpster is delivered and ends on the scheduled pickup date.
Additional days are subject to availability and charged at $20 per dumpster, per day. Please request an extension before the scheduled pickup whenever possible.
Pickup times are estimates, not guaranteed appointments. Routing, weather, traffic, disposal-facility hours, and equipment availability may affect timing.
The dumpster and the full approach route must be safely accessible at pickup. Parked vehicles, locked gates, snow, ice, mud, construction activity, low branches, loose animals, blocked access, or other unsafe conditions may result in a $75 trip fee and continued rental charges until pickup can be completed.
A delay caused solely by Huckleberry Dumpsters will not be treated as an additional rental day.
Orders cancelled more than 24 hours before scheduled delivery are not subject to a cancellation fee unless we have already incurred a clearly disclosed nonrefundable cost.
8. Equipment damage, property risk, and liability
All dumpsters and related equipment remain the property of Huckleberry Dumpsters.
You are responsible for damage beyond ordinary wear and tear when caused by misuse, prohibited materials, fire, impact, machinery, unauthorized movement, vandalism, theft, or another event while the dumpster is under your possession or control, except to the extent caused by Huckleberry Dumpsters.
Dumpster delivery and pickup involve heavy commercial equipment. Even when reasonable care is used, the truck or dumpster may leave marks, impressions, cracks, ruts, stains, settling, or other damage on asphalt, concrete, pavers, gravel, lawns, landscaping, curbs, or underground improvements.
You accept the ordinary and foreseeable risks of placing heavy equipment at the selected location, including risks from hidden, weak, aged, improperly constructed, or weather-affected surfaces. This includes damage involving sprinklers, irrigation systems, water or gas lines, electrical or communications lines, septic tanks, drain fields, dry wells, French drains, culverts, utilities, and other conditions that are not visible to the driver.
You must notify Huckleberry Dumpsters promptly after discovering property damage, equipment damage, a safety issue, a billing question, or another service concern. You should preserve relevant photographs, video, messages, and other evidence and allow us a reasonable opportunity to inspect the condition before repairs are made, except when immediate action is reasonably necessary to prevent injury or further damage.
Huckleberry Dumpsters remains responsible for damage to the extent directly caused by our negligence or willful misconduct, subject to applicable law.
To the fullest extent allowed by law, Huckleberry Dumpsters is not liable for lost profits, lost business, loss of use, project delay, loss of data, or other indirect, incidental, special, exemplary, or consequential damages.
You agree to defend, indemnify, and hold harmless Huckleberry Dumpsters LLC and its owners, employees, agents, and service providers from third-party claims, fines, losses, damages, and reasonable costs arising from your prohibited materials, unauthorized placement, unlawful use, negligence, misrepresentation, violation of law, or breach of these Terms, except to the extent caused by Huckleberry Dumpsters’ negligence or willful misconduct.
9. Delays and refusal of service
Unless we specifically agree otherwise in writing, delivery and pickup times are estimates rather than guaranteed appointment times.
We may delay, reroute, reschedule, suspend, or cancel service because of severe weather, wildfire, smoke, excessive heat, snow, ice, flooding, high winds, road restrictions, traffic incidents, disposal-facility closures or delays, mechanical problems, labor or material shortages, emergencies, governmental action, or another condition outside our reasonable control.
We may refuse, stop, or terminate service whenever our driver or another representative reasonably believes the service would be unsafe, unlawful, abusive, fraudulent, materially different from what was ordered, harmful to equipment or property, or inconsistent with disposal-facility requirements.
If fire, smoke, heat, leaking material, a chemical reaction, or another hazardous condition is found, we may contact emergency services, isolate or unload the dumpster, and take other reasonable protective action. The Customer is responsible for resulting costs to the extent the condition was caused by prohibited material, misuse, negligence, or a breach of these Terms.
We may also refuse future service for nonpayment, chargebacks, threats, harassment, repeated access problems, intentional misuse, prohibited materials, or serious violations of these Terms.
10. Legal terms
Photos and documentation
You authorize us to take photographs or video of the delivery route, placement area, dumpster, load, and nearby property when reasonably needed to document service, access, damage, safety, prohibited materials, billing, insurance, or compliance with these Terms.
Governing law and disputes
These Terms are governed by Idaho law. Before filing a lawsuit, both sides agree to make a good-faith effort to resolve the issue through direct communication.
Unless applicable law requires another location, any court proceeding relating to these Terms or the service must be brought in a court of competent jurisdiction in Ada County, Idaho. Either party may use an appropriate Idaho small-claims court when eligible.
Entire agreement
These Terms, together with the applicable order, invoice, written quote, and any signed addendum, are the complete agreement for the rental.
Severability and no waiver
If a provision is found invalid or unenforceable, the remaining provisions continue in effect. A delay or failure to enforce a term does not waive the right to enforce it later.
Electronic records and communications
You agree that electronic acceptance, checkboxes, typed names, online orders, emails, and text messages may be used to form and document the rental agreement to the extent permitted by law. Order confirmations, invoices, receipts, notices, and other rental communications may be sent by email, text message, website, or the booking platform. Standard carrier rates may apply.
Changes to these Terms
We may update these Terms when our services, pricing, disposal rules, equipment, or legal obligations change. The version in effect when you place an order generally applies to that rental unless we agree otherwise in writing.
11. Questions or service concerns
Questions about these Terms, a charge, or an active rental should be directed to Huckleberry Dumpsters.
